Our Practice Areas
Civil law is based on the Greek Civil Code, which was enacted in 1946 and is heavily influenced by Roman law. The code regulates all private law matters, such as property, contracts, torts, family law, and succession.
Some key features of civil law include:
- Ownership of Property: In Greece, property ownership is highly valued and protected. Property rights are absolute and ownership can only be transferred with the owner's consent.
- Contract Law: Greek civil law emphasizes the importance of contracts. Contracts are legally binding agreements between two or more parties and must be in writing in order to be enforceable.
- Tort Law: In Greece, a person who suffers damage or loss as a result of the actions of another person can sue for compensation in a civil court.
- Family Law: Greek civil law recognizes marriage as a legal union between two people. Divorce is also recognized, and the law provides for the division of property and custody of children.
- Inheritance Law: Greek civil law regulates the transfer of property upon a person's death. Inheritance can be regulated by a will, or if there is no will, by the rules of intestate succession.
Civil disputes in Greece are typically handled by the civil courts, which are divided into first-instance courts, appeal courts, and the Supreme Court. The process for filing a civil case in Greece can be complex and involves several stages, including the submission of written pleadings and oral arguments in court.
